GENERAL ISSUES

· By purchasing a ticket from Water Park, you and all members of your party agree to be bound by the terms and restrictions set forth in this agreement.

· If you are purchasing tickets for someone else, you are legally responsible for their compliance with these terms and conditions and will be treated as their authorized agent.

· To book the Water Park Experience (the "Activities") and any additional products at the location specified in Water Park's booking confirmation, you must agree to these Terms and Conditions.

· You understand and agree to abide that you are responsible for making sure all members of your party are made aware of and accept these Terms and Conditions since they contain important information on participation by you and members of your party.

· We, Waterparksindubai.com, doing business as "Water Park," are a company based in Dubai, United Arab Emirates, and these Terms and Conditions cannot be changed unless Water Park specifically agrees to such a change in writing.

· Any booking confirmation or other documentation issued by Water Park (including any electronic documentation) may have typographical, clerical, or other errors or omissions and may be updated without incurring any liability on Water Park's behalf. When necessary, Water Park may alter its Activities to meet legal or other obligations.

RESERVATION VERIFICATION

· The only way a reservation is considered confirmed is if Water Park confirms it in writing (including via email).

· Despite having the freedom to alter its prices at any time, Water Park will uphold already paid-for reservations.

· The Privacy Policy and Waiver of Water Park are incorporated herein by reference.

·  In the unlikely event that Water Park receives an incorrect booking confirmation from you, you must notify them as soon as possible (at the very latest, within 24 hours). Each participant is responsible for arriving on time, and Water Park will do what it can to get the event started on time for everyone who has paid for it.

· No use of illegal substances, alcoholic beverages, or tobacco products is permitted at any time or in any area of the building.

SAFETY

· The Activities have difficult hurdles, and doing them puts one in danger of severe or even deadly injury. By signing the waiver, you confirm that you are aware of and willing to accept the risks associated with the activity and release Water Park from all liability in the event of your injury or death. In addition, before and during your time in the arena, you must read and abide by all posted rules and restrictions.

· To the extent that the recreational activities were not maintained with due care and skill or were not reasonably fit for their purpose or because of a breach of contract, negligence, statute, or statutory duty by Water Park, neither Water Park nor its directors, employees, or agents shall be liable to you, your dependents, or legal representatives for any personal injury or death suffered by you or any members of your party.

· Water Park can kick someone out of the activities if they do not abide by the set rules, or they can refuse to let them in if they are being disruptive. This includes anyone who is suspected of being under the influence of intoxicating substances like that drugs or alcohol or who repeatedly disregards safety advice and the safety system.

· Participants of all ages will not be under the constant watch of marshals.

· Those taking part must be under 120 kilograms and in generally good health and physical condition. If a member of the Water Park staff determines that you do not meet entry requirements or are no longer appropriate for the attraction, that determination will be final.

· If you have any questions or concerns, you should visit the arena before your reservation and talk to a member of the Water Park staff. Those who do not satisfy these standards will be barred from participating in the Activities. Every single member of your group must fit these criteria, and it is on you to make sure they do.

· The Activities are strenuous on the body and call for a certain level of quickness, strength, and endurance. It is important for participants to work within their capabilities; ultimately, only the person can truly know his or her own strengths and weaknesses. Do not try a difficult maneuver or task if you are not confident in your ability to execute it. Participants should see their doctors before time if they have any health concerns. All participants must sign a declaration stating that they are in good health and not at increased risk of being involved in an accident that could cause harm to themselves or others. Water Park's activities are not suitable for pregnant women for obvious safety considerations related to the physical nature of the activities.

· You acknowledge that a certain level of physical fitness and skill is required to participate in Water Park's services. You represent and take responsibility that neither you nor any member of your party or anyone you have paid for has or has ever had any medical condition, such as pregnancy, epilepsy, breathing or heart-related issues, or anyone wearing a cast, that would make it unsafe for you to participate in such activities.

· Participants' eyesight should be comparable to that of a driver in order to safely finish the activity and to monitor any participants younger than 12 under their care. Those who need corrective lenses for their vision, whether near or far, must wear them. If Water Park determines that any participant is behaving inappropriately, it may prohibit that individual from continuing with the Activities.

· Children under the age of 12 are not permitted in our facilities without the constant supervision of an adult (18+). The adult should be present but need not participate in any of the planned activities.

CLOTHING

· It is the responsibility of each participant to dress correctly at all times; Water Park recommends that guests wear swimwear and other items they do not mind getting wet and muddy in.

· The second rule is that long hair must be restrained.

·  In addition, women who wear veils are only allowed to use non-sharp hair clips. For your own protection, we ask that you not use any pins or safety pins.

· For the safety of everyone involved, please remove any belts, jewelry, or other sharp articles of clothing.

· If you participate in the Activities and your clothing or other personal goods become damaged or lost, Water Park is not responsible for it.

REFUNDS, CHANGES, AND CANCELLATIONS

· All sales are final; refund requests must be made in writing and approved by management.

· You agree that Water Park has the right to cancel your reservation at any moment. Water Park will do its best to contact you as soon as possible if it cancels your reservation. In the event of cancellation, the patrons are eligible for this provision, you may be entitled to a full refund, but nothing apart from that shall be granted.

· Your reservation will be canceled without a refund if there is any proof that the reservation or any associated tickets or wristbands have been tampered with in any way. All tickets and wristbands are non-transferable and cannot be resold; they remain the property of Water Park at all times.

· You will not be eligible for a refund if Water Park is forced to discontinue the Activities after your group has already begun taking part in them due to circumstances beyond the company's control (in part or in whole). Water Park reserves the right but is not obligated to offer discounted rates for rescheduled events.

· If you paid by using a debit or credit card, your money would be returned to the same card. Water Park has the right to issue refunds through credit or check when multiple payment methods are utilized.

The Cost and Method of Payment

·Unless otherwise specified in an agreed-upon written document between Water Park and you, all of our fees will be based on the then-current rate structure, and full payment will be expected at the time of booking. The price of the Activities is factored into the total. Cash, personal checks, or credit/debit cards are all acceptable methods of payment.

LIABILITIES

· Except as expressly mentioned in these Terms and Conditions, Water Park assumes no responsibility for any loss or damage to property or person as a result of the booking or participation in the Activities.

· In the event of a personal injury, you authorize Water Park to take whatever action it deems reasonably necessary to protect your welfare or the welfare of any person in your party, including the need for emergency medical treatment and ambulance transportation, and you agree to pay the associated costs.

· Except as expressly laid out in these Terms and Conditions, Water Park's responsibility will be limited to the number of fees actually paid by you to Water Park.

· Nothing in these Terms and Conditions is intended to, or shall, restrict Water Park's liability for death or any personal injury caused by the negligence of Water Park or of its employees, agents, or contractors.

MISCELLANEOUS

· References to our Privacy Policy in these Terms and Conditions are incorporated into and form part of that policy.

· You understand and accept that photographs and videos may be recorded at the facility for both security and advertising purposes. This can contain photos of you, other adults in your group, and even youngsters. Photos or videos taken during the event may be shared on social media sites like Facebook, YouTube, Instagram, Twitter, and/or Snapchat, and you agree to this. You agree that the use of any such photos and/or video footage is for advertising, marketing, and promotional purposes or social media usage only and is not meant to insult, defame, or slander any person, and you give this consent on behalf of yourself and any members of your party, including but not limited to dependents and minors in your care.

· If Water Park deems that your behavior is too risky or you fail to follow the rules, they have the authority to suspend or cancel your participation in any of their events.

· Damage to the premises, its furnishings, or its fittings, whether accidental or deliberate, shall be charged to the person who made the reservation.

· The remaining provisions hereof shall survive, remain in ,full force and continue to be binding and enforceable if any provision hereof is held to be illegal, invalid, or otherwise unenforceable.

· Nothing in the foregoing shall give any other person or entity any right to benefit from or to enforce any of these Terms and Conditions.

· The laws of the United Arab Emirates shall govern and be applied to these Booking Terms and Conditions, and you agree to submit to the exclusive jurisdiction of the legal courts located in Dubai for all purposes arising out of or related to these Booking Terms and Conditions.
